SMS Terms & Conditions

These Terms & Conditions ("Terms") govern your participation in the STAX VIP Buyer List SMS program (the "Program"), operated by STAX Real Estate LLC ("STAX," "we," "us," or "our") on the number (786) 686-0963. By opting in to the Program, you agree to these Terms.

1. Program Description

The STAX VIP Buyer List is an opt-in text-message program for commercial real estate buyers. Once you opt in, STAX sends periodic promotional and informational messages about new and updated commercial property listings — gas stations, convenience stores, and net-lease (NNN) retail — that STAX is bringing to market. The Program also accepts your inbound replies and questions, which are answered by our assistant "Kate" or routed to a licensed STAX broker. STAX does not send messages to anyone who has not opted in.

2. How to Opt In

You can opt in to the Program by (a) submitting the VIP signup form at staxre.com/vip-signup and checking the SMS consent box, or (b) emailing vip@staxre.com to request to join the list. By opting in, you consent to receive recurring automated promotional and informational text messages from STAX at the mobile number you provide. Consent is not a condition of purchasing any property or service. After you opt in, you will receive a one-time confirmation message before any other messages are sent.

3. Message Frequency

Message frequency varies. You will generally receive approximately 2–6 messages per month, sent when STAX has a new listing, a price or status change, or other information relevant to commercial real estate buyers. You may also receive replies to questions you initiate.

4. Message & Data Rates

Message and data rates may apply, depending on your mobile carrier and plan. STAX does not charge a fee for participating in the Program, but your carrier may charge for sending and receiving text messages. Please contact your wireless carrier for details about your messaging plan.

5. Opt Out (STOP)

You can cancel the SMS service at any time. Reply STOP to any message you receive from us, and you will no longer receive SMS messages from the Program. We will send a final confirmation message acknowledging that you have opted out. If you want to rejoin the Program later, sign up again at staxre.com/vip-signup or text us to resubscribe.

7. Supported Carriers

The Program is available on most major U.S. wireless carriers, including AT&T, T-Mobile, Verizon, U.S. Cellular, Boost Mobile, Cricket, MetroPCS, and others. Carriers are not liable for delayed or undelivered messages. Service availability and message delivery are not guaranteed.

8. Eligibility

You must be at least 18 years old, or the age of majority in your state, to participate in the Program. By opting in, you represent that you are the account holder of the mobile number provided, or that you have authorization from the account holder to enroll that number.

9. Limitations of the AI Assistant

"Kate" is an AI-powered assistant that helps answer general questions about STAX listings and investment opportunities. Kate has access to a limited set of information and is not a substitute for personalized brokerage, legal, tax, or investment advice. Material decisions about a property or transaction should be confirmed directly with a STAX broker. STAX makes no warranty regarding the accuracy or completeness of automated responses.

10. Privacy

Your privacy is important to us. Information you provide through the Program is handled in accordance with our SMS Privacy Policy. Mobile information (including your phone number, opt-in status, and the content of messages exchanged with the Program) is not sold and is not shared with third parties or affiliates for their marketing or promotional purposes.

11. Changes to These Terms

STAX may update these Terms from time to time. The most current version will always be posted at staxre.com/sms-terms. Your continued participation in the Program after changes are posted constitutes acceptance of the updated Terms.
