SMS Terms & Conditions

These Terms & Conditions ("Terms") govern your use of the STAX Buyer Support SMS program (the "Program") operated by STAX Real Estate LLC ("STAX," "we," "us," or "our"). By providing your mobile phone number and opting in to the Program, you agree to these Terms.

1. Program Description

The STAX Buyer Support SMS program provides automated, conversational responses to buyer inquiries about STAX listings, off-market opportunities, gas station and net-lease investment information, and related deal questions. Messages are delivered through our AI assistant, "Kate," which is powered by DealNgn and operates on STAX's behalf. Kate responds only when you initiate a conversation by texting our published number or after you opt in through one of our forms.

2. How to Opt In

You can opt in to the Program by (a) submitting a STAX web form that discloses SMS opt-in (such as a buyer inquiry, off-market interest, or contact form), (b) replying to a STAX message with a confirmation keyword such as YES or START, or (c) texting our published Program number directly. By opting in, you consent to receive automated text messages from STAX and Kate at the mobile number you provide.

3. Message Frequency

Message frequency varies based on your inquiries and engagement with the Program. You will generally receive messages only in response to questions you initiate. STAX may also send occasional follow-up or transactional messages directly related to a deal you are working on with us.

4. Message & Data Rates

Message and data rates may apply, depending on your mobile carrier and plan. STAX does not charge a fee for participating in the Program, but your carrier may charge for sending and receiving text messages. Please contact your wireless carrier for details about your messaging plan.

5. Opt Out (STOP)

You can cancel the SMS service at any time. Reply STOP to any message you receive from us, and you will no longer receive SMS messages from the Program. We will send a final confirmation message acknowledging that you have opted out. If you want to rejoin the Program later, simply text us again or sign up through one of our forms.

6. Help (HELP)

7. Supported Carriers

The Program is available on most major U.S. wireless carriers, including AT&T, T-Mobile, Verizon, Sprint, U.S. Cellular, Boost Mobile, Cricket, MetroPCS, and others. Carriers are not liable for delayed or undelivered messages. Service availability and message delivery are not guaranteed.

8. Eligibility

You must be at least 18 years old, or the age of majority in your state, to participate in the Program. By opting in, you represent that you are the account holder of the mobile number provided, or that you have authorization from the account holder to enroll that number.

9. Limitations of the AI Assistant

Kate is an AI-powered assistant designed to answer general questions about STAX listings and investment opportunities. Kate has access to a limited set of information and is not a substitute for personalized brokerage, legal, tax, or investment advice. Material decisions about a property or transaction should be confirmed directly with a STAX broker. STAX makes no warranty regarding the accuracy or completeness of automated responses.

10. Privacy

Your privacy is important to us. Information you provide through the Program is handled in accordance with our SMS Privacy Policy. Mobile information (including your phone number, opt-in status, and the content of messages exchanged with the Program) is not sold and is not shared with third parties or affiliates for their marketing or promotional purposes.

11. Changes to These Terms

STAX may update these Terms from time to time. The most current version will always be posted at staxre.com/sms-terms. Your continued participation in the Program after changes are posted constitutes acceptance of the updated Terms.
