SMS Privacy Policy

This SMS Privacy Policy describes how STAX Real Estate LLC ("STAX," "we," "us," or "our") collects, uses, and protects information you provide when you participate in the STAX Buyer Support SMS program (the "Program"). This Policy applies specifically to data collected through SMS interactions with our automated assistant, "Kate," which is operated on STAX's behalf using the DealNgn platform and delivered via Twilio.

1. Information We Collect

When you opt in to and use the Program, we collect:

• Your mobile phone number.
• Your name and email address, if you provided them during opt-in.
• The content of text messages you send to and receive from the Program.
• Metadata associated with the messages, such as date, time, and delivery status.
• The property, listing, or topic your inquiry references, if applicable.

2. How We Use Your Information

We use the information collected through the Program only to:

• Respond to your inquiries about STAX listings, off-market opportunities, and related investment questions.
• Operate, maintain, and improve the Program and the underlying AI assistant.
• Connect you with a STAX broker when your inquiry warrants personalized follow-up.
• Comply with legal obligations, enforce our Terms, and protect against fraud or abuse.

4. Service Providers

We rely on a small set of trusted service providers to operate the Program:

• Twilio — delivery of SMS messages between you and STAX.
• DealNgn — the platform that operates the "Kate" AI assistant on STAX's behalf.
• Hosting and analytics providers — limited operational use only.

These providers are contractually limited to using your information solely to deliver the Program and may not use it for their own marketing or to share with their affiliates for marketing.

5. Legal Disclosures

We may disclose information when required by law, subpoena, court order, or other legal process, or when we believe in good faith that disclosure is necessary to protect our rights, your safety, or the safety of others, to investigate fraud, or to respond to a government request.

6. Data Retention

We retain SMS conversation data for as long as it is reasonably needed to operate the Program, support active deal conversations, and comply with our recordkeeping obligations under federal and state real estate, financial, and consumer-protection laws. When information is no longer needed, we delete or de-identify it on a regular schedule.

7. Security

We use industry-standard administrative, technical, and physical safeguards to protect information collected through the Program. No method of transmission over a mobile network or storage is 100% secure, and we cannot guarantee absolute security.

8. Your Choices and Rights

You can stop receiving messages from the Program at any time by replying STOP to any message you receive. You may also request access to, correction of, or deletion of personal information we hold about you by emailing michael@staxre.com. Depending on your state of residence, additional rights may apply under state privacy laws (such as the California Consumer Privacy Act). We will honor verifiable requests as required by applicable law.

9. Children's Privacy

The Program is not directed to children under 18, and we do not knowingly collect information from minors. If you believe a minor has provided information to the Program, please contact us so we can remove it.

10. Changes to This Policy

We may update this Policy from time to time. The most current version will always be posted at staxre.com/sms-privacy. Material changes will be highlighted by updating the "Effective" date at the top of this page.
